Radar fall detection: No camera image does not mean no personal data

Image-free sensing may reduce data collection. Still assess identification, alarm handling and the limits of the actual product.

Contexto y fuentes

Sensor events may be personal data through room or account attribution. If they reveal health information, Article 9 GDPR also matters. Absence of an optical image does not make processing anonymous. [1]

Privacy by design requires defining necessary collection and safeguards. Review recipients, retention, movement histories, availability and responsibilities for the actual system. [1], [2]

Distinguish a sensor alert from subsequent interventions. Section 1831 BGB addresses deprivation of liberty under its conditions; a technology label alone cannot determine whether an intervention falls within it. [3]

Alcance y límites

No detection rate, three-second response or universal legal superiority over cameras is guaranteed. Assess any medical product claims separately against the intended purpose.

Explicación sencilla

Fictional example: A controlled pilot separately tests detection, delivery and acknowledgement. Detecting an event without a functioning response route is insufficient.

Recomendaciones prácticas

Our recommendation: Examine raw data, analytics, retention and less intrusive alternatives. Explain the system and assess whether a data protection impact assessment is required.

Agree acceptance criteria for detection, false alarms and outages. Use supervised safe tests, not dangerous falls involving residents. Define alarm ownership, fallback procedures and function checks. Do not repurpose events into unnecessary resident or staff movement profiles.
