Voice messages in clinical handovers: Control storage and acknowledgement

Audio may expose confidential information or be misunderstood. Define handover, documentation and lost-device procedures before relying on it.

Contexto y fuentes

Stored audio can contain resident health information and exist on several devices. Assess recipients, retention and access. Article 33 GDPR requires breach notification unless a risk is unlikely; where notification is required, it must be made without undue delay and within 72 hours of awareness where feasible. Loss of a device alone does not determine the outcome. [1]

A recognisable voice is not automatically special-category biometric processing. Articles 4(14) and 9 distinguish technical identification processing and its purpose. The health content may be sensitive independently. [1]

Section 630f BGB governs records within its treatment-contract scope. An isolated voice message is not automatically a properly attributed record. Recording someone else's private conversation raises a separate issue under section 201 of the German Criminal Code. [2], [3]

Alcance y límites

Audio is not necessarily stored unencrypted, and not every lost device requires regulatory notification. This article gives no medication advice.

Explicación sencilla

Fictional example: A nurse sends an observation, but the recipient listens after the shift ends. The failure is the lack of an agreed urgent handover and acknowledgement route.

Recomendaciones prácticas

Our recommendation: Specify suitable uses of audio. Use an acknowledged pathway for urgent or treatment-critical information and clarify ambiguous statements. Test storage, backups and lock-screen exposure.

Assign responsibility for entering relevant information into the clinical record and removing unnecessary copies. Establish immediate lost-device reporting and feasible blocking measures. Have the privacy team document the incident risk assessment and notification decision.
