Smart Fall Sensors, Bed Mats & GPS Trackers – Data Protection or Deprivation of Liberty?
Validated facts
Sensor floor mats, infrared room monitoring and GPS watches for dementia patients help prevent falls. Legally, systems that acoustically report leaving the bed or room or that monitor movement and trigger return may constitute a deprivation of liberty measure under § 1831 Abs. 4 BGB. They require approval by the guardianship court if the resident cannot consent themselves (cf. AG Bad Iburg on GPS on a rollator, 11 XVII K 3258).
In plain language
A digital alarm at the bed is often legally comparable to a raised bed rail: it can restrict freedom of movement and then needs a court order.
Security relevance & practical tip
Have every sensor system legally cleared by the data protection officer and the home supervisory authority before purchase.
