Hidden Cameras in the Care Room – May Relatives Film Care Workers?
Factos validados
Relatives increasingly install smart surveillance cameras (Nest, Ring, baby monitors) in residents’ rooms to uncover misconduct. Covert filming violates care workers’ general personality rights (Art. 2 Abs. 1 GG) as well as data protection (Art. 6 GDPR) and may be punishable under § 201a StGB (violation of the highly personal sphere of life by means of image recordings) – whereby the Higher Regional Court of Hamm (OLG Hamm, 4 ORs 24/25) clarified that not every recording automatically fulfils the offence; an intrusion into the intimate sphere must also be present. Video surveillance is only permissible if all persons who enter have effectively consented in advance or if a viable legal basis exists.
Explicação simples
The care room is not a public space, but neither is it a law-free film set. No one has to be secretly filmed at work – anyone who sets up a camera without labelling and permission risks civil and criminal consequences.
Relevância de segurança e dica prática
Facilities must establish clear house rules and train care staff on how to respond when they discover covert cameras.
