Wearables and dementia: Separate location data, autonomy and restrictive actions

A tracker is neither automatically deprivation of liberty nor automatically lawful care. Assess wishes, authority, data and actual intervention.

Contexte et sources

Section 1831 BGB governs deprivation of liberty under specified conditions. Examine what happens after an alert: showing a location differs from physically preventing departure. The statute is not general permission for every tracking use. [1]

Location and vital-sign processing require a suitable basis, with additional health-data conditions. Consent requires assessment of information, voluntariness and capacity; a dementia diagnosis alone does not determine these for every situation. [2]

Access control and availability also need attention. Organisational arrangements must anticipate the actual device's operational limits. [3]

Portée et limites

No unnamed body of case law is presented as blanket permission. Family relationship alone does not establish authority to approve every measure. Assess representation and any required court approval.

En termes simples

Fictional example: One resident chooses location support for independent outings. Another proposed use would immediately prevent every departure. Identical hardware does not make the interventions equivalent.

Recommandations pratiques

Our recommendation: Document the person's wishes, support objective, actions and legal authority. Review potentially restrictive elements separately. Limit recipients and location-history storage to what is needed.

Test battery warnings, disconnection, a removed device and alert response. Define fallback care and responsible contacts. Reassess whether the arrangement still supports the person's actual needs and choices.
