Voice assistants in care rooms: Support independence while limiting capture

Voice control may help residents. Assess microphone behaviour, visitors, care conversations and residents’ choices before deployment.

Contexte et sources

EDPB guidance distinguishes command handling, request execution and additional purposes such as model improvement or profiling. Wake-word behaviour, transmission and retention need separate examination. A microphone alone does not establish continuous uploading of all conversation. [1]

A care room is both personal living space and a place for confidential care. Unauthorised recording of another person's private speech can engage section 201 of the German Criminal Code. A resident's wish for voice control does not automatically authorise recording everyone else. [2]

Purpose, transparency, minimisation and an appropriate basis are required. Consider visitors and staff too. A cognitive diagnosis alone does not establish incapacity to consent. [3]

Portée et limites

No universal approval or prohibition of named consumer devices is asserted, nor a fixed daily false-activation rate. Local processing is not automatic legal compliance.

En termes simples

Fictional example: A resident wants voice-controlled lighting. The facility assesses a limited function and a reliable microphone-off procedure during confidential conversations.

Recommandations pratiques

Our recommendation: Start with the person's wishes and whether a less data-intensive aid meets the need. Assess activation, server contact, history and deletion. Control accounts and remote access.

Test microphone deactivation during care and visits, provide appropriate information and reassess added services or cameras. Limit approval to functions actually examined.
