AI dictation at the bedside: Recording authority, data flow and clinical review

Dictating notes differs from recording a patient conversation. Assess recording authority, processing and human approval before introducing AI notes.

Contesto e fonti

A professional dictating after an encounter is different from recording patients or roommates during it. Section 201 of the German Criminal Code protects private speech against unauthorised recording. Establish recording authority and everyone potentially captured; a GDPR assessment alone does not settle this issue. [1]

The German Data Protection Conference recommends defining purposes, legal grounds, data flows and responsibilities for AI. A model name does not establish whether a particular deployment processes locally or in a cloud. [2]

Medical-device qualification depends on intended purpose. Writing assistance is not automatically equivalent to diagnostic or therapeutic decision software, and automatic summarisation alone does not settle classification. [3]

Section 630f BGB requires timely and traceable treatment records. An AI draft is not already a clinically reviewed entry. [4]

Ambito e limiti

No universal time-saving percentage or claim that all accurate dictation requires cloud processing is made. Local processing does not eliminate errors or unauthorised access.

Spiegato in modo semplice

Fictional example: A facility pilots post-encounter dictation rather than continuous recording. The professional checks the draft against observations and approves it before filing. This is not an effectiveness study.

Raccomandazioni pratiche

Our recommendation: Define microphone activity, recording authority and a workable non-recording alternative. Assess storage, deletion, secondary use and contractual responsibilities.

Use fictional data to test names, negations, dates and units. Require accountable professional approval before record entry. Record the deployed version and limitations, and reassess if functions or medical recommendations change.
